Appeal from a judgment of the General Term of the Supreme Court, in the first district, affirming a judgment at Special Term. The action was for the construction of the will of John M. Smith, of the city of New York. He made Ms last will in August, 1858, and died in January, 1861. At the date of his will, and when he died, Ms children and heirs-at-law were: 1. Lafayette Smith, who had a wife, Julia Smith.
