LA BUY, District Judge.
The government has filed its motion to dismiss the complaint without prejudice as to thirty-six named defendants pursuant to Rule 21 and Rule 41(a) (2) of the Federal Rules of Civil Procedure, 28 U.S.C.A.
The issue before the court is whether the court should allow the dismissal without prejudice. The defendants urge that the dismissal, if any, should be with prejudice for the following reasons:(1) that such a dismissal would irreparably harm and effect the defense which these defendants would be called upon to make should a second suit be brought against them in that…
