This matter is before the court on defendant’s Motion to Dismiss and plaintiffs’ Cross Motion for Partial Summary Judgment.1 2Plaintiffs, nineteen (19) present and former border patrol agents, brought this action pursuant to 8 U.S.C. § 1353a (1931) (1931 Act) and the Fair Labor Standards Act (FLSA) (codified as amended at 29 U.S.C. §§ 201-219 (1988)), or, alternatively, under the Federal Employees Pay Act of 1945 (FEPA), 5 U.S.C. §§ 5541-5550a (1945), seeking additional overtime compensation for work performed by them as employees of the Immigration and…
