This is an action at law on covenants in a lease of *504real estate. The praecipe for summons and declaration were filed in tile Duval Circuit Court on the 7th day of November, 1881.
The declaration alleges that Edward M. L’Engle, trustee for Susan L’Engle, and Madeline L’Engle, plaintiff in the court below, and defendant in error in this court, let to Charles O.
