This is an original proceeding in habeas corpus. Petitioner alleges that he is unlawfully restrained of his liberty by Herman C. Martin, as agent for the state of New Mexico, that he is charged with being a fugitive from said state by reason of having broken the terms of a parole granted him by the board of parole of said state; that he has complied with all the terms of his parole, and is not a fugitive from justice.
