It appears from the undisputed facts that the land in controversy is included in the town site of Denver, which was entered in the proper land office by James H. Hall, county judge of Arapahoe county, May 6, 1865, under and in pursuance of the act of congress relating to town sites, passed May 23, 1844, as extended May 28, 1864.
