This is ■■a appeal from a judgment of the district court of Marshall county sustaining a demurrer to the plaintiffs’ first amended petition and dismissing their action. The facts out of which the controversy arose are about as follows: On the 30th of October, 1016, Oscar Driver and Pearl I. Driver, his wife, made a deed purporting to convey to Lidie Barry and John H. Ussery certain lands located in Murray county Okla., aggregating 370 acres, for a consideration of $6,300.
