LESLIE, Chief Justice.
J. Kahn & Company instituted this suit against the Texas & New Orleans Railroad Company for the recovery of damages for the loss of cotton destroyed by fire on the platform of the Kaufman Compress Company at Kaufman, Texas. The defendant answered by general demurrer, general denial and specially alleged that at the time of the fire the cotton was in the possession and control of *293the owner or shipper .through its agent, the compress company.
