Appeal by the plaintiff, Israel Boss, an infant, by Abraham Boss, his guardian ad litem, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of New York on the 13th day of December, 1901, upon the verdict of a jury rendered by direction of the court, and also from an order entered in said clerk’s office on the 19th day of December, 1901, denying the plaintiff’s motion for a new trial made upon the minutes.

This action was brought to recover damages for injuries sustained by the infant plaintiff in a hallway of premises Ho. 159 Orchard street in the city of. Hew York, which premises belonged to the defendant. It is alleged in the complaint that the defendant wrongfully, carelessly and negligently allowed a heavy iron railing to remain in a dangerous position against a wall in the hallway of the premises, and that while the infant plaintiff was passing through the hallway this railing fell upon and seriously injured him.
