The Mississippi and Tennessee Railroad connected with- the Mississippi Central Railroad at Grenada, immediately south of the Tallobusha river. This connection was made in 1861. Error to the Circuit Court of Tallobusha county. Hon. ’Win. Cothran, judge. The Mississippi and Tennessee Railroad connected with- the Mississippi Central Railroad at Grenada, immediately south of the Tallobusha river. This connection was made in 1861. In 1863, the bridges of both roads across the Tallobusha river were burned by the military forces. Both roads being in an embarrassed financial condition after the close of the war, in 1865, agreed to build, upon the piers of the Mississippi Central Railroad bridge, which were left standing, a partnership bridge. The first case, No. 11057, is an action of ejectment; the second, an appeal from the verdict of a “jury of review,”'to condemn and assess damages for the right of way for a road-bed of five-eighths of a mile, from the line of the old road-bed of the Mississippi and Tennessee Railroad Company, to connect with the track of the Mississippi Central Railroad Company, on the north side of the Yallobusha river.
The same questions are involved in both cases, and by desire of counsel they will be decided together.
