CATHELL, Judge.
In resolving the instant appeal, we shall address an issue of first impression—the immunity from civil liability of retail establishments under Maryland Code (1973, 1995 Repl.Vol.), *180§ 5-378 of the Courts and Judicial Proceedings Article (CJ). In toto, that section, as codified, now reads:
