Plaintiff, The Nature Conservancy of the Pine Tree State, Inc. (Conservancy), commenced a civil action on May 19,1976 in the Superior Court (Lincoln County) for a declaratory judgment against defendants, the Town of Bristol and three individuals,— William E. Benner, Stanford L. Tukey and Carroll M. Hanna in their capacities as members of that Town’s Board of Tax Assessors. Subsequently, each of the parties moved to be awarded summary judgment.
