Appeals from an order of the Supreme Court, Erie County (Donna M. Siwek, J.), entered March 15, 2005 in a personal injury action. The order, among other things, denied the motion of defendants Holland Central School District and James Makowski for summary judgment and granted the motion of defendant Town of Golden for summary judgment dismissing the complaint and all cross claims against it.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously modified on the law by denying the motion of defendant Town of Golden in part and reinstating the complaint…
