Appeal from a judgment of the Supreme Court (Muller, J.), entered August 31, 2012 in Essex County, which denied petitioner’s application for a writ of habeas corpus, in a proceeding pursuant to CPLR article 70, without a hearing.

Petitioner, who is serving an aggregate prison sentence of 8V3 to 25 years as a result of his 1993 conviction of two counts of rape in the first degree (People v Reed, 212 AD2d 962 [1995], lv denied 86 NY2d 739 [1995]), was later convicted in 1995 of two counts of promoting prison contraband in the first degree and sentenced to concurrent prison terms of 2V2 to 5…
