HENRY, Associate Justice.

This suit was brought by appellant to recover $2000, which he charged was the balance of the purchase money of a tract of land lying in Navarro County sold and conveyed by him to the defendant, and praying for a foreclosure of his vendor’s lien. The defendant answered. The judge filed the following conclusions of fact and law:
