This is a suit for recognition of a homestead exemption. The defendant, having a judgment against plaintiff for .several hundred dollars, had his farm seized and advertised for sale. Plaintiff obtained an injunction, stopping the sale, on the allegation that the farm, containing only 86 acres, was his homestead and was therefore exempt -from seizure. The defendant filed an exception of no cause of action, because the plaintiff had not alleged that he was the head of a family or had any one dependent upon him for support.
