Slidell, J.

Franklin Wharton, deceased* intermarried with Amanda J. Walker, then widow of Sandifer Hoggatt, in May 1835, in Natchez, Mississippi. At the time of the Celebration of the marriage, Wharton was a citizen of this State, residing in New Orleans, and engaged in the practice of the law. Mrs. Hoggatt Was on a visit to her relatives at Natchez, and was a resident of Tennessee. The intention of the parties was to live in N. Orleans, the husband’s domicil.
