Annie B. Johnson sued the Unified Government of Athens-Clarke County (“the unified government”) and William Swan for the death of her five-year-old son who drowned in a swimming pool owned and operated by the unified government through its recreation department. Swan was employed by the unified government as a lifeguard at the pool, and there is no dispute that he was on duty when Johnson’s son drowned.
