It is alleged by the plaintiff in her declaration, and was contended on her behalf at the trial, that the payment of the installment of the premium maturing February 17, 1889, according to the terms and conditions of the policy was waived by the defendant. The denial of this contention forms the vital issue in the case. It is urged in this court as a question of law by appellant, on the theory that there is no competent evidence fairly tending to prove such waiver.
