In the district court for Gage county, Pickett, a duly licensed physician, sued Colgrove for services rendered to one Lee Taylor, a son-in-law of Colgrove. The peti*441tion alleges that these services were rendered at the special instance and request of the defendant, and for which the defendant promised to pay. The answer was a general denial. The evidence discloses that Taylor was taken sick at Colgrove’s house and that he requested his father-in-law to send for a physician.
