This case comes up by appeal from the decree of the circuit court of the United States for the district of West Tennessee, by which the bill of the complainants was dismissed. The bill states, that Patrick M’Cutchen, a citizen of the state of Tennessee, departed this life some time in the year 1812, having shortly before, in the same year, made his last will and testament, which, after his death, had been duly pioved and re corded.
