The- chief complaint of the government concerning the trial of this case is that the defendant was permitted to introduce certain evidence tending to show an alleged compliance on his part with the act of June 3, 1878 [U. S. Comp. St. 1901, p. 1528], and that the jury was instructed that, if they believed from this evidence that the defendant *72had substantially complied with that act and with the rules adopted by the secretary of the interior thereunder, he would be entitled to their verdict.
