CHRISTIAN, Judge.

The offense is murder; the punishment, confinement in the penitentiary for three years.

Appellant, who is a white man, had gone to a negro dance. Deceased, Topsie Draper, who is a negro, was present at the dance. State’s witnesses testified that appellant had brought some whisky to the dance. Appellant • denied this. A negro man by the name of Charlie Cole worked in appellant’s home.
