MARTIN, Circuit Judge:

Petitioner Vernon Madison, an Alabama prisoner on death row, appeals from the District Court’s denial of his petition for writ of habeas corpus after a federal evi-dentiary hearing. We granted Mr. Madison a certificate of appealability on the question of whether the prosecutor in his case engaged in racially discriminatory jury selection in violation of Batson v. Kentucky, 476 U.S. 79, 106 S.Ct. 1712, 90 L.Ed.2d 69 (1986), and the Fourteenth Amendment to the U.S. Constitution.
