Judgment unanimously modified on the law and as modified affirmed and matter remitted to Monroe County Court for further proceedings in accordance with the following Memorandum: Defendant appeals from a judgment convicting him following a nonjury trial of burglary in the second degree (Penal Law § 140.25 [2]) and four counts of grand larceny in the fourth degree (Penal Law § 155.30 [1]). Contrary to the contention of defendant, the People met their burden of establishing that the police had probable cause to arrest him.
