In an action to recover damages for breach of contract, the plaintiff appeals from an order of the Supreme Court, Kings County (Baily-Schiffman, J.), dated October 12, 2012, which granted the motion of the defendant Khan Enterprise Construction, Inc., pursuant to CPLR 4401, made at the close of the plaintiffs case, for judgment as a matter of law dismissing the complaint.
Ordered that the order is reversed, on the law, with costs, the motion of the defendant Khan Enterprise Construction, Inc., pursuant to CPLR 4401 for judgment as a matter of law dismissing the complaint is denied, and the…
