1. INTRODUCTION
On November 2000, a ski train fire in Kaprun, Austria killed 155 individuals and left twelve survivors. In addition to a mediation that took place in Austria, American and foreign survivors and/or relatives of those who die d in the fire brought multiple lawsuits in federal court against numerous defendants (the “In re Ski Train Litigation”).
