On March 31, 2009, Petitioner Ludens Denis, a citizen of Haiti, filed this petition pursuant to 28 U.S.C. § 2241 while he was in the custody of the Department of Homeland Services Immigration and Customs Enforcement (“DHS/ICE”) awaiting deportation pursuant to a final order of removal. In or about April 2009, Petitioner was removed to Haiti. Respondent subsequently filed a motion to dismiss the petition as moot. On May 13, 2009, the Honorable Victor E.
