Plaintiff in error, hereinafter referred to as defendant, was charged in a two-count information with murder by abortion. On the first, charging commission by an instrument, the verdict was guilty; on the second, charging commission by noxious drugs, not guilty. He was sentenced to from ten to twelve years in the state penitentiary. To review that judgment he prosecutes this writ.
