I find reversible error.

Tbe record shows that tbe jury retired at 11:45 a. m. to consider tbe verdiet, returned into court at 3:55 p. m. and received further instruction, returned again at 4:45 p. m. and received additional instruction, returned again at 11 p. m., and then tbe following occurred in tbe absence of defendant and bis counsel:
