In an action to foreclose a mortgage, the defendant Alex Kushnir appeals, as limited by his brief, from so much of an order of the Supreme Court, Kings County (Bayne, J.), dated September 3, 2014, as denied that branch of his motion which was pursuant to CPLR 3215 (c) to dismiss the complaint insofar as asserted against him as abandoned and, sua sponte, directed the plaintiff to submit an order of reference. The notice of appeal from an order of reference dated October 16, 2014, is deemed to be a notice of appeal from the order dated September 3, 2014 (see CPLR 5512 [a]).
