TJOFLAT, Circuit Judge:
Section 955a(e) of Title 21 of the United States Code makes it a crime “for any person on board any vessel within the customs waters of the United States to knowingly or intentionally ... possess with intent to ... distribute” marijuana. This appeal questions whether the Congress, in enacting this statute, intended to reach the possession of marijuana by foreigners aboard a foreign vessel on the high seas.1 The district court held that Congress did not so intend and dismissed the indictment.2 We reverse.
