WILSON, District Judge.

In the early part of 1917, John Taylor, Sr., of Marion county, Ky., died testate leaving a large estate, considerable portion of which, consisting entirely of lands, was located in Texas. In his will, John Taylor, Jr., and J. Clark Taylor were named as executors. The will directed the executors to reduce the assets of the estate to cash by selling same at either public or private sale. The executors came to Texas to do this, as applied to the Texas lands. No ancillary administration was sued out as could have been under articles 3352 and 3365 of Revised Civil Statutes…
