The above entitled cause is now being determined as an error proceeding by reason of defendant’s appeal on questions of law from the judgment of the Court of Common Pleas of Montgomery County, Ohio.

Plaintiff’s petition was filed May 18, 1943 and thereby she sought a judgment giving her the right to participate in the insurance fund as the widow and sole dependent of her deceased husband, Daniel W.
