Appeal from the Circuit Court for Frederick County, in Equity. The appeal in this case was taken from a decree of the lower Court (Lynch, J,) rejecting and setting aside the report of sale made by the trustee in the cause, and dismissing the plaintiff’s supplemental bill, and leaving him to his remedy at law to maintain his rights to the land in controversy, by an action in ejectment. The case is stated in the opinion of this Court.

The appeal is taken in this case from a decree setting aside the sale of land made by a trustee, appointed by the Circuit Court for Frederick county, and from an order dismissing a supplemental bill filed in the same case. An agreed statement of facts is incorporated in the record, and forms a part of the testimony of the case.
