Plaintiff filed a five-count Complaint, alleging two Family and Medical Leave Act (“FMLA”) claims against Southwest Surgery Center (“Southwest”) and Michael Cherny (“Cherny”) individually: Count I is an FMLA interference claim,, and Count II is an FMLA retaliation claim.
