BERRY, Judge.

Appellant was convicted in the district court of Titus County for the offense of an accomplice to murder and his punishment assessed at confinement in the pen itentiary for a term of six years. This is a companion case to that of Gray v. State.

The indictment contains three counts, the first count charges that Otis Ballard was killed by G. C. Gray and that prior to the commission of the offense by said Gray, appellant advised, encouraged and aided the said Gray to commit the offense.
