Plaintiff, pro se, brought an action against defendant for unpaid wages, vacation time and commissions in the circuit court of Cook County pursuant to the Illinois Wage Payment and Collection Act (Ill. Rev. Stat. 1991, ch. 48, par. 39m — 11 (now 820 ILCS 115/11 (West 1992))). Defendant subsequently presented, without notice to plaintiff, an "Emergency Motion.” At the ex parte hearing on the motion, the trial court dismissed plaintiff’s second amended complaint with prejudice and, on a later date, awarded defendant attorney fees and costs.
