Reversing.

This action was brought by the appellant, Henry Pfisterer, against the appellees Joseph H. Peter & Co., to recover *504damages for a personal injury which resulted to him from the falling of a scaffold on which he was standing while in their service, which it is alleged was caused by the negligence of the defendants in its construction. There is no dispute as to the facts, which may be stated briefly as follows:
