OPINION and JUDGMENT

DALTON, Chief Judge.

The action presently before the court is a complaint brought under section 205(g) of the Social Security Act, 42 U.S.C. § 405(g), to review a final decision of the Secretary of Health, Education and Welfare.

*620The decision rendered by the hearing examiner on June 4, 1970 became the final decision of the Secretary when the Appeals Council denied the plaintiff’s request for review on August 21, 1970.

The hearing examiner’s decision denied the plaintiff his claimed disability insurance benefits because the claimant had not established that he was suffering…
