This action was brought by the plaintiff, American General Fire and Casualty Company [“American General”], 1 pursuant to the Declaratory Judgments Act, 28 U.S.C. §§ 2201 et seq. American General alleges that it is entitled to indemnification from the defendant, Truck Insurance Exchange [“TIE”], for claims arising out of a motor vehicle accident which occurred on March 11, 1983, in Kansas City, Kansas.
