OPINION

ORME, Judge:

11 Defendant Kenneth J. Webster appeals his conviction of one count of wrongful appropriation of a motor vehicle. Specifically, he argues that out-of-court statements made by his wife, as well as his statement regarding a prior arrest for a similar offense, should not have been admitted at trial. He also challenges the trial court's determination that, under the statutory scheme in effect at the time, wrongful appropriation of a motor vehicle is a third degree felony.
