—In an action, inter alia, to recover damages for personal injuries, the plaintiff appeals from an order of the Supreme Court, Kings County (Rappaport, J.), dated December 9, 1998, which denied her motion for partial summary judgment on the issue of liability.

Ordered that the order is modified, on the law, by deleting the provision thereof which denied that branch of the plaintiff’s motion which was for partial summary judgment on the issue of liability as against the defendant Dominick Milillo, and substituting therefor a provision granting that branch of the motion; as so modified, the…
