ZAVATT, Chief Judge.

This is an action under Section 205(g) of the Social Security Act, as amended, 42 U.S.C. § 405(g), to review a final decision of the Secretary of Health, Education, and Welfare denying the plaintiff’s claim for reinstatement as a recipient of mother’s insurance benefits under Section 202(g) of the Act, 42 U.S.C. § 402(g). It is before this court on defendant’s motion and plaintiff’s cross-motion for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure. The facts are not in dispute.
