delivered the unanimous Opinion of the Court:

Laura B. Lemacks died in the State Hospital in Columbia on May 20, 1941. Her brother-in-law, J. C. Lemacks, filed in the Probate Court of Colleton County and procured on May 28, 1941, the probate of her purported will dated September 28, 1928, of which he was sole beneficiary and was also executor. It recited that the testatrix was a resident of Walterboro, Colleton County, “but now in Columbia, South Carolina,” and was witnessed by the superintendent and two other members of the medical staff of the -hospital…
