The following taken from appellant’s brief gives a correct statement of the nature and result of the suit: “The appellant Gray sued appellee F. M. Cockrell for partition of real estate situated in Dallas County, and for an adjustment of equities arising during their joint ownership, whereby appellant claimed that appellee Cockrell had become indebted to him in certain sums of money, for the repayment of which the appellant claimed a lien on the interest of appellee Cockrell in the land sought to be partitioned.
