The. aPPedee being possessed of a tract of land, on the 2d day of February, 1803, sold the sameto the appellant fof the pr}ce 0f four thousand dollars, and gave an obligation, conditioned to convey to the appellant by deed of general warranty, the tract of land whereon the appellee then lived, containing 610 acres on the south side of KentUc-river and 40 acres on the fiorth side, and to include the ferry, be the same more or less.
