Tingling, J.), entered October 17, 2003, which denied plaintiff’s motion for a default judgment and deemed defendant’s answer served, unanimously reversed, on the law and the facts, without costs, plaintiffs motion for a default judgment granted and defendant’s cross motion for, among other things, an order compelling plaintiff to accept his answer denied.
