MORRIS SHEPPARD ARNOLD, Circuit Judge.

Dana Kopp appeals from the order of the district court dismissing her tort claim for lack of subject-matter jurisdiction. We reverse.

I

Ms. Kopp was attacked, restrained, and sexually assaulted in her own home by her ex-husband, Donald Kopp. When Mr. Kopp was charged with forcible sodomy and felonious restraint, he pleaded guilty to the latter charge and was sentenced to four years in prison. Ms. Kopp then sued Mr. Kopp in federal court, claiming violations of the Violence Against Women Act of 1994, see 42 U.S.C. § 13981, and of state tort law as well.…
