Appeal from an order and judgment of the Supreme Court (Rumsey, J.), entered January 7, 1997 in Cortland County, which, inter alia, granted defendant’s motion for summary judgment dismissing the complaint.

In March 1992 defendant, acting as its own general contractor for a multiphase housing development on land it owned in the City of Cortland, Cortland County, entered into a subcontract with third-party defendant, the employer of plaintiff Kevin J.
